Richard Gilbert has practiced exclusively in the field of employee benefits law since 1974. He is now special counsel at Trucker Huss in San Francisco and previously practiced at Orrick (1981-2009), Paul Weiss (1977-80) and Thompson Hine (1974-77). He advises employers, trustees, public pension funds, and financial institutions on the fiduciary responsibility provisions of ERISA and public pension law, as well as the design and implementation of numerous types of 401(k), retirement and executive benefit plans. Richard advises pension fund investors and serves as outside counsel on fiduciary investment matters for both corporate and public sector investment funds. He also advises venture capital, real estate and other investment fund sponsors. Richard served as co-lead counsel in obtaining and expanding ERISA exemptions enabling plan assets to be invested in credit card and mortgage-backed pass-through certificates and their expansions to broaden the ERISA market for other asset-backed pass-through certificates. Richard received his BA from Yale in 1968, served nearly three years in military espionage and earned his JD from the University of Wisconsin-Madison in 1974.
