Diane Soubly

Diane M. Soubly is one of the few attorneys nationally who has been elected a Fellow of the College of Labor and Employment Lawyers and the American College of Employee Benefits Council.

As an Adjunct Professor in the Labor and Employment Certification Program at Chicago-Kent College of Law for a decade, she has developed four courses: Employee Benefits Law and Litigation; Tribal Law; Harassment, Bullying, Human Trafficking, and Violence in the Workplace; and Privacy Rights in Employment. One of her students won a writing award in the ACEBC annual writing competition.

She has 40 years of experience in plan design (including Affordable Care Act and HIPAA “Final Rules” compliance) and in ERISA and employee benefits litigation brought as class actions or by multiple/individual plaintiffs (including claims for pension and health care benefits for employees and retirees, severance pay benefits, executive compensation, benefit denial or revocation, illegal plan design), claims of fiduciary breach in both the private and public sector (including prohibited transactions, stock drop, and excessive fees), discrimination claims under various statutes, ERISA 510 claims, trustee disputes, and claims involving multiemployer plans.

She also has over 40 years of experience before agencies and in individual, multiple plaintiff, and class action litigation alleging employment claims (including collective bargaining disputes, force reduction plans, discrimination, trade secrets and wage and hour litigation, and employment termination).

A former member of the ICLE Labor Advisory Board for over ten years before practicing outside of Michigan, and a former Board member of the American Benefits Council and a member of its Health Care Task Force, she is a frequent contributor and presenter on labor and employment and employee benefits issues for state and national organizations. The Contributing Editor of the Benefits Law Journal and a member of its Editorial Advisory Board, she is a frequent author of amicus briefs for national associations such as The Chamber of Commerce of the United States and the American Benefits Council on labor and employment and employee benefits issues.

Diane has judged briefs in the ACEBC Nell Hennessey Annual Moot Court Competition every year since its inception, and she serves on the Adjunct Professors Committee and on the Deceased Fellows Website Committee.

She has been recognized in Best Lawyers and Super Lawyers in Labor and Employment, Employee Benefits, and ERISA Litigation.
